Non-compliance with these obligations may result in immediate suspension or termination of your access to the Platform and possible legal action.

3. Platform Availability and Maintenance

3.1 Service Availability

We strive to maintain high availability and accessibility of our Platform at all times. However, relyon AG cannot guarantee uninterrupted, complete accessibility. Temporary limitations of access and service disruptions may occur due to technical reasons that are outside our control.

3.2 Scheduled Maintenance

Regular maintenance procedures are essential to guarantee the functionality, security, and efficiency of the Platform. These maintenance activities will be planned and announced in advance wherever feasible. However, brief limitations of service availability may occur during scheduled maintenance windows.

3.3 Limitation of Liability for Technical Issues

relyon AG will assume no responsibility for damages, losses, or costs resulting from unplanned outages or service disruptions unless caused by intentional misconduct or gross negligence on our part.

4. Data Protection and Security Measures

4.3 Type of Data Processed

Our Platform processes exclusively business-related data essential for operating your services and functionalities offered by our Platform. Personal data beyond the explicitly defined business context is neither requested nor processed by our platform.

4.4 Data Storage and Hosting Location

To ensure full compliance with GDPR, all User data processed and stored by relyon AG is securely hosted exclusively on servers located within the European Union (EU).

In exceptional cases, should transfer of data to third countries outside the EU become necessary, relyon AG undertakes to notify Users clearly and transparently ahead of such transfers. Such data transfers will only occur after explicit consent has been provided by the User concerned.

5. Modification of Terms of Use

relyon AG reserves the right to amend or modify these Terms of Use periodically. Users will be notified of substantial changes to these Terms clearly and in due time through our Platform or by email notification. Continued use of the Platform following such notifications is considered consent to and acceptance of these amendments.

6. Limitation of Liability

Except in cases of intentional misconduct or gross negligence, relyon AG explicitly excludes liability for any indirect, incidental, consequential, or punitive damages arising from Platform usage or temporary service interruptions. Specifically, relyon AG assumes no liability for loss of profits, revenues, or reputational harm resulting directly or indirectly from Platform usage or temporary service outages or disruptions.
